Introduction
The County Clerk's Office records documents that affect title to real property located in Deschutes County. When a document is received for recording it is checked for compliance with Oregon statutes. If a document cannot be recorded, it is returned to the sender with an explanation of what is wrong. As a document is recorded an index is created and the image scanned for document retrieval. All recorded documents are microfilmed and a duplicate is sent to the State Archive.
This office is prohibited from:
• Giving legal advice
• Helping fill out documents
• Suggesting what type of documents to use
• Accepting illegible documents
• Recording documents other than those specified by Oregon and federal law

Credit Reports
The County Clerk's Office preserves and makes available to the public including credit reporting agencies all records affecting the title to real property. The Clerk's Office does not distribute information to credit reporting agencies. Credit reporting agencies that provide information regardless of its accuracy should be contacted directly. If an error appears on your credit report our office may be able to assist you in finding the source information. It is your responsibility to identify misinformation and to work with the agency(ies) in removing any mistakes found in a credit report.
Legibility Requirements
In accordance with state laws, the County Clerk's Office shall preserve all records affecting the title to real property. All documents are permanent records and must be legible for the integrity of the public record.
Non-Standard Form Fee
A $20.00 non-standard fee is added in addition to all other fees to instruments that do not meet the requirements as defined in ORS 205.232, 205.234, and 205.327. For more information see Recording Checklist.
Legal Descriptions
A legal description is not a tax lot number or street address. Acceptable legal descriptions are:
• A subdivision name with lot and block Click here to view index to recorded subdivisions
• A metes and bounds description
• Partition plat recording and parcel number
• Reference to a Book and Page of any previously recorded Deschutes County public record where the description may be found
Recording of Corrected Documents (ORS 205.244)
Any document that has been previously recorded may be re-recorded to make corrections in the original document.
The corrected document need not be acknowledged again.
A statement shall be written on the first page of the document or a first page attached to the document. We recommend you use our cover page if you're attaching a new first page. The statement shall contain the words:
"Re-recorded to correct ______________ previously recorded in Book _________ and Page _________ and/or Fee Number ______________."
If you do not have the original document to correct and re-record with the above statement you will need to request a certified copy of the instrument. The next step is to record the certified copy of the instrument without any corrections. Once you receive back the recorded certified copy you will then be able make the necessary corrections and re-record the document with the statement above.
